Lawyers Demand Senators Refund Salaries for Poor Performance, Dual Legislative Roles

The Association of Legislative Drafting and Advocacy Practitioners (ALDRAP) has initiated legal action to compel Nigerian senators to refund portions of their salaries and allowances collected since May 2023, citing alleged poor performance and violations of constitutional provisions.

In a pre-action notice dated May 26, 2025, addressed to Senate President Godswill Akpabio, ALDRAP demanded that the 109 senators of the 10th National Assembly refund 78% of their salaries and allowances for delivering only 12% of their statutory duties to constituents, whom the lawyers describe as dissatisfied consumers. The notice, signed by ALDRAP’s Administrative Secretary, Amuga Jesse Williams, was obtained by DAILY POST on Tuesday.

Additionally, the group is targeting 40 senators who concurrently hold membership in the Nigerian Senate and the ECOWAS or Pan-African parliaments, alleging this violates Section 68 of the 1999 Constitution, which prohibits dual legislative roles. These senators are being asked to refund all salaries and allowances received during this period.

The lawyers have approached the Federal Competition and Consumer Protection Tribunal (FCCPT) under the Federal Competition and Consumer Protection Commission Act, 2018. The pre-action notice, a procedural requirement before a tribunal summons, was copied to key officials, including President Bola Tinubu, the Chief Justice of Nigeria, the Executive Vice-Chairman of the FCCPT, the Accountant-General of the Federation, the Governor of the Central Bank of Nigeria, and the secretaries-general of the ECOWAS and Pan-African parliaments.

ALDRAP claims that records indicate the Senate has performed at just 12% capacity since May 2023. They are urging the tribunal to order the refund of 78% of the senators’ earnings to the national treasury via the Accountant-General, citing inadequate service delivery to constituents.
