S’ Court reserves judgement in Binani’s case against Fintiri

The Supreme Court has deferred its decision on the appeal lodged by the All Progressives Congress (APC) and its gubernatorial candidate, Aisha Dahiru, widely known as Binani, against Adamawa state governor Ahmadu Fintiri.

Binani’s challenge to Fintiri’s victory in the gubernatorial election held last year was previously dismissed by both the tribunal and the Court of Appeal.

Following arguments presented by the parties involved, the five-member panel, headed by John Okoro, adjourned the case for judgment.

During the proceedings, Binani’s main argument, as articulated by her counsel, Akin Olujimi, centered on the legality of the contentious declaration made by the Resident Electoral Commissioner, Hudu Ari.

This stance echoed the tribunal’s October 28 decision, which rejected Binani’s petition due to her failure to substantiate allegations of overvoting.

The tribunal deemed her case lacking in evidence, as she did not submit necessary documents to support her claims challenging the election outcome.

Former INEC REC, Hudu Ari, had declared Senator Binani as the winner of the election while collation was going on, thereby violating the provisions of Section 25 of the Electoral Act, 2022, which gives only the returning officer the right to declare election results for governorship polls.

Immediately after the announcement, INEC declared the pronouncement to have no effect and announced Finitiri as the duly elected winner of the election.

In a swift move, INEC also suspended Ari from any of its engagements.
