Florida Woman Sentenced for Infant’s Death 40 Years Later

Terry McKirchy, a 62-year-old Florida woman, has been sentenced to three years in prison for causing the death of Benjamin Dowling, a man who passed away at 35 from injuries inflicted when he was an infant in her care nearly four decades ago.

In 1984, Benjamin was just five months old when McKirchy, then 22, was babysitting him. Under her care, he sustained a severe head injury, later diagnosed as shaken baby syndrome. His parents, alarmed by his condition, rushed him to the hospital, where doctors confirmed the life-altering damage. Although McKirchy pleaded no contest to injuring Benjamin back in 1985, she had consistently denied any wrongdoing.

On August 21, 2024, McKirchy was held accountable for Benjamin’s death, which occurred in 2019, a consequence of the injuries he suffered as a baby. During a poignant court session, Benjamin’s mother read from her journal, recalling the harrowing moment she picked up her son from McKirchy’s home, with his ghostly pale appearance and vacant stare.

Benjamin’s mother shared the devastating impact on his life, explaining how he never experienced a normal childhood, no school, no prom, no driving, and no typical relationships. “He never got to say he loved us,” she said, illustrating the depth of his loss.

In 1985, McKirchy took a plea deal, pleading no contest to attempted murder, which led to a lighter sentence due to her pregnancy. When Benjamin died, his death was directly linked to the injuries he sustained as an infant, leading prosecutors to charge McKirchy with first-degree murder in 2021. She eventually pleaded guilty to manslaughter as part of a plea agreement.

In court, McKirchy’s lawyer read an apology letter she had written, expressing deep remorse for her actions, acknowledging the harm she caused Benjamin and his entire family.
