 Central New York mother charged under rarely used law after son’s crime spree

UTICA, NEW YORK - A Utica woman has been arrested on a rarely used charge after police said her 11-year-old son went on a crime spree and she failed to intervene.

Nurto Mohamed, 36, was taken into custody Tuesday by Utica Police’s Patrol Division and Juvenile Aid Unit and charged with endangering the welfare of a child, a misdemeanor, for “failure to exercise due diligence in control of a child.” Authorities said Mohamed’s son has been involved in at least four felonies, including a robbery, along with numerous misdemeanors since early 2025.

Police also said the boy and a 12-year-old accomplice recently committed a burglary that damaged several vehicles, stole two cars, and drove them around the city, causing additional property damage. Mohamed had been made aware of her son’s actions and offered assistance services, but reportedly did not take steps to control his behavior.

Because of his age, the boy cannot be charged, but authorities determined that intervention was necessary to prevent further criminal activity. “After consultation with the District Attorney’s Office, it was determined that this rarely used charge could be levied due to the overwhelming amount of public nuisance this child has caused,” police said.

Under New York law, a parent or guardian can be charged with endangering the welfare of a child if they fail to prevent a child under 18 from becoming an “abused child,” “neglected child,” “juvenile delinquent,” or “person in need of supervision.” Mohamed pleaded not guilty at her arraignment in Utica City Court and was released on her own recognizance. The charge carries a maximum of one year in jail or up to three years of probation.

Police said they hope the charge remains a last-resort option and will continue to work with parents and community providers to ensure children follow safe and appropriate behaviors.
