A Los Angeles court has turned down Cher’s request for a temporary conservatorship over her son, Elijah Blue Allman, after a hearing held on Friday, April 24.
The judge denied the petition without prejudice, meaning it can be refiled later, but made clear there was not enough immediate cause to grant it at this stage. The court noted it did not see “sufficient urgency” in the request involving Allman, 49.
During the hearing, Allman joined remotely from a psychiatric hospital in Connecticut, where he is currently receiving treatment while dealing with criminal proceedings in New Hampshire tied to two separate cases.
He has been placed there in an effort to restore competency, according to court information shared during the session.
The judge also pointed out that because Allman is currently in hospital care and facing active legal matters, concerns about access to funds from his late father Gregg Allman’s trust did not meet the threshold for emergency intervention. Cher had argued that money he receives is quickly spent in ways she believes are harmful.
In her filings, Cher, 79, claimed her son is “gravely disabled” and struggling with long-standing mental health and substance issues, saying his financial decisions are not stable and that he lacks control over spending.
She also alleged that funds are often used rapidly on items such as drugs, hotels, and transportation.
Addressing the broader legal standard, the judge remarked, “A lot of people don’t show up to court and get a default judgment and don’t need a conservatorship,” adding, “I am going to deny the temporary conservatorship without prejudice.”
This is not the first time Cher has sought legal oversight of her son’s affairs. She initially filed for a temporary conservatorship in December 2023, naming herself as proposed conservator.
That petition was later withdrawn in September 2024. At the time, Allman’s legal team described the decision as one that allowed both sides to focus on “healing and rebuilding their family bond.”
In the more recent filing, Cher argued that her son’s situation had worsened since then, stating that his life had “significantly deteriorated,” and repeating concerns about his ability to manage finances and maintain stability.
She also suggested he has “no concept of money” and is unable to handle his resources responsibly.
