AN 8-YEAR-OLD SPECIAL NEEDS CHILD DESPERATELY SOUGHT HELP WHILE CHOKING DURING SCHOOL LUNCH, THE AIDE FAILED TO UNDERSTAND AND SIMPLY SENT HIM TO THE BATHROOM, WHERE HE COLLAPSED. THE BOY PASSED AWAY 5 DAYS LATER. (PHOTOS).

When an 8-year-old special needs child desperately sought help while choking during school lunch, the aide failed to understand and simply sent him to the bathroom, where he collapsed. The boy passed away 5 days later.

On February 25th, 2025, Cruzito Ruiz was eating his lunch at Bass Elementry School in Las Vegas, Nevada, when he began to choke on a  chunk of pineapple.

Cruzito approached Teresa Holve (a special education aide) and desperately signaled that he was choking. He pointed at his mouth and chest with his hands. He desperately patted his own back. He made constant attempts to signal he was choking. One of Cruzito's friends even tried to tell Teresa Holve that something was very wrong with Cruzito.

However rather than recognize the danger the child was in, a seemingly distracted Holve sent Cruzito to the restroom, where he collapsed, alone.

Cruzito laid in the bathroom for 5 minutes before students discovered him (he was blue) and alerted staff. He was then deprived of oxygen an additional 15 minutes before EMS arrived.

Once on scene, EMS personnel quickly removed the pineapple chunk with their fingers. However, by that point, it was too late for Cruzito.

He was rushed to St. Rose Dominican Hospital, where doctors diagnosed Cruzito as suffering an anoxic brain injury due to his brain being deprived of oxygen.

Cruzito would never regain consciousness and was declared brain dead on March 2nd, 2025, just two weeks short of his 9th birthday.

Now, the family of Cruzito Ruiz has filed a lawsuit against Clark County School District.

The suit was filed in the U.S District Court on Tuesday, March 3rd, 2025.

In the suit, attorneys on behalf of Amanda Corbala (Cruzito's mother), state that Teresa Holve neglected to help Cruzito despite her having completed mandatory CPR training. The suit also claims the district failed to properly train its employees to address students who are choking.

Cruzito had suffered a TBI when he was 3 years old and as a result, was placed on an IEP to help overcome his disabilities.

Our thoughts are with this family and we will update this story.
