Ondo Election: NNPP’s Edema Seeks Court Order to Remove APC’s Aiyedatiwa from INEC Candidate List

Hon. Olugbenga Edema, the gubernatorial candidate of the New Nigeria People’s Party (NNPP) in Ondo State, has filed a suit at the Federal High Court seeking to compel the Independent National Electoral Commission (INEC) to remove Governor Lucky Aiyedatiwa of the All Progressives Congress (APC) and his deputy from the list of candidates for the upcoming gubernatorial election.

Edema’s legal action, which seeks a ruling on the interpretation of Section 15 of the Third Schedule to the 1999 Constitution of Nigeria (as amended), challenges the validity of Aiyedatiwa’s nomination. He contends that the APC primary election held on April 20, 2024, was unconstitutional and violated the Electoral Act, 2022.

In the originating summons (Suit No. FHC/AK/CS/103/2024), filed through his counsel, Abayomi Ojo, Edema has listed INEC as the 1st Respondent, APC as the 2nd Respondent, and Aiyedatiwa and his deputy as the 3rd and 4th Respondents. The suit seeks to invalidate INEC's inclusion of the APC candidates in the list for the November 16 election, alleging violations of the Electoral Act.

The suit states: “Whether, by virtue of Section 84(13) of the Electoral Act, 2022, INEC is required to exclude the names of the 3rd and 4th Defendants (Aiyedatiwa and his deputy) from the list of candidates due to their nomination in an unlawful primary held on April 20, 2024, as supported by Exhibits NNPP02-19, which contain reports from various wards and local government areas across Ondo State.”

Edema is requesting the court to make the following declarations:

1. Unconstitutional Publication: A declaration that INEC’s publication of Aiyedatiwa and his deputy as APC candidates is unconstitutional, invalid, and void under Sections 15 of the Third Schedule of the Constitution and Sections 82(1)(5) and 84 of the Electoral Act, 2022.

2. Invalid Nomination: A declaration that INEC’s acceptance of the APC’s gubernatorial candidates was unlawful and arbitrary.

3. Order to Quash Nomination: An order invalidating the nomination and publication of Aiyedatiwa and his deputy by INEC for the November 16 election, asserting that it violates constitutional and electoral law provisions.

Edema’s legal challenge highlights the importance of adhering to constitutional and electoral laws in the nomination process, particularly as preparations for the Ondo State gubernatorial election unfold.
