Governor Monday Okpebholo and the All Progressives Congress (APC) have secured a significant victory in the ongoing petitions challenging their win in the September 21, 2024, governorship election in Edo State. The Edo State Governorship Election Petition Tribunal has dismissed a petition filed by the Action Alliance (AA) and Adekunle Rufai Omoaje, citing lack of merit and frivolity.
The Tribunal's ruling centered on Omoaje's lack of locus standi, as his petition was not based on election-related matters. Furthermore, the Tribunal noted that Omoaje did not participate in the governorship election, thereby lacking the authority to question the election's validity.
Omoaje's grievances stemmed from not being recognized as the National Chairman of the Action Alliance for nominating candidates. However, the Tribunal held that his claims had no basis in the Electoral Act of 2022.
The petition had sought to declare Okpebholo and APC's win as illegal due to non-compliance with the Electoral Act, alleging corruption and questioning the validity of the votes. Additionally, Omoaje claimed that the AA was not allowed to nominate a lawful governorship candidate.
INEC had declared Okpebholo the winner with 291,667 votes, defeating Asue Ighodalo of the Peoples Democratic Party (PDP), who secured 247,655 votes.
