 Court Dismisses Case Seeking Control of Brotherhood of the Cross and Star's Properties


The High Court of Rivers State, presided over by Honourable Justice E. Thompson, has struck out a case filed by a group attempting to take control of properties owned by the Brotherhood of the Cross and Star. The court deemed the case, filed under suit number PHC/797/2024, as incompetent.


The group had challenged the authority of the Brotherhoodā€™s leader, Olumba Olumba Obu, seeking enforcement of their rights to worship at and own several worship centers in Rivers State. The applicants filed the case in June 2023, claiming a violation of their fundamental rights.


However, Justice Thompson ruled that the matter was about property ownership, not the infringement of human rights, and criticized the applicants' legal approach, which attempted to mislead the court. The court emphasized that the use of an originating summons, rather than a writ of summons, rendered the case without merit.


The legal representatives for the Brotherhood expressed gratitude for the judgment, affirming the lawful leadership of the organization. The administrator of the Brotherhood in Rivers State, Archbishop Emmanuel Ogwutum, reiterated that the judiciary is a vital avenue for justice.


Following the ruling, the applicantsā€™ lawyer, E. E. Obomanu, thanked the court for refraining from imposing punitive costs against his clients. It is worth noting that the court had previously dismissed a similar case filed by Obomanu for non-compliance with legal procedures.
