Enugu Withdraws from Governors' Lawsuit Against EFCC and NFIU

The Enugu State Government has withdrawn from the ongoing lawsuit filed by 16 state governments in the Supreme Court, which challenges the authority of the Economic and Financial Crimes Commission (EFCC), the Nigeria Financial Intelligence Unit (NFIU), and other anti-corruption agencies over state governments, particularly questioning their legitimacy since the states did not consent to their creation.

Enugu's withdrawal follows a similar move by three other states—Ebonyi, Anambra, and Adamawa—on October 23, reducing the number of plaintiffs in the case. Despite these withdrawals, the seven-member panel of justices at the Supreme Court has reserved judgment on the matter.

According to court documents obtained by our correspondent, Enugu State's Attorney General, Kingsley Udeh, filed an application for the state's withdrawal on October 21. However, the application could not be processed by the court on October 23, as it had not yet been received by the Supreme Court’s Registrar. It was officially received and stamped on October 24, 2024.

When reached for comment, Enugu State Attorney General Kingsley Udeh declined to provide any details. Governor Peter Mbah’s Special Adviser on Mainstream Media, Dan Nwomeh, referred all inquiries to the Attorney General's office.

The lawsuit, identified as SC/CV/178/2023, includes a formal notice of withdrawal titled, "NOTICE OF 6TH DEFENDANT’S (ATTORNEY GENERAL OF ENUGU STATE) WITHDRAWAL FROM THIS SUIT," which states that the 6th Plaintiff (Enugu State Attorney General) intends to withdraw from the case against the defendant (Attorney General of the Federation).

The notice, dated October 21, 2024, was signed by Attorney General Dr. Kingsley T. Udeh, along with I. I. Eze, Esq. (Director), and S. U. Madu (Deputy Director) of the Ministry of Justice, Enugu.

It is important to note that the case was initially filed by the Kogi State Government against the EFCC in 2023, with 15 other states, including Enugu, later joining as plaintiffs. The case has sparked considerable criticism from civil society organizations.
