Presidential Election Tribunal: Peter Obi, Atiku file appeal as they head to Supreme Court

The Labour Party and its presidential candidate in the February 25th presidential election, Peter Obi, has filed an appeal against the September 6, 2023 ruling of the Presidential Election Petition Court (PEPC) at the Supreme Court.

Labour Party's lawyers led by Livy Uzokwu (SAN) approached the Supreme court on 51 grounds which they “termed an error in law to prove that President Bola Tinubu who was the candidate of the All Progressives Congress (APC) did not win the election and that it was wrong for both INEC and the PEPC to declare him winner of the election when many incontrovertible points were proving otherwise.”

The National Publicity Secretary of Labour Party, Obiora Ifoh said this in a statement on Tuesday, September 19

The presidential candidate of the Peoples Democratic Party (PDP), Abubakar Atiku, also filed an appeal at the Supreme Court, seeking nullification of the judgment of the Presidential Election Petitions Court, which upheld the declaration of President Bola Tinubu as the winner of the 2023 election.

In the notice of appeal, Atiku insisted that the tribunal committed a miscarriage of justice in its findings and conclusion in its petition challenging the Independent National Electoral Commission (INEC)’s declaration of Tinubu as President.

The notice of appeal is also praying the apex court to set aside the whole findings and conclusions of the Tribunal on the grounds that they did not represent the true picture of the grounds of his petition.

Atiku claimed that the tribunal erred in law when it failed to nullify the presidential election held on February 25, 2023, on the grounds of non-compliance with the Electoral Act 2022, when by the evidence before the Tribunal, ‘’INEC conducted the election based on grave and gross misrepresentation, contrary to the Electoral Act 2022.''

On the 6th of September, Nigeria’s presidential election tribunal ruled that Nigeria’s main opposition parties failed to prove claims of electoral malpractice against the governing All Progressives Congress (APC) in February’s disputed elections.
