The Special Offences Court in Lagos has denied a request by Godwin Emefiele, the former Governor of the Central Bank of Nigeria (CBN), to remove Justice Rahman Oshodi from his corruption trial. Emefiele's legal team, led by Olalekan Ojo, SAN, had accused Justice Oshodi of bias and urged him to recuse himself from the case, citing that the judge allowed a leading question from the prosecution despite the defense's objection.Ā¹
However, in his ruling on Wednesday, Justice Oshodi dismissed the request, stating that the allegations of bias were unsubstantiated. The court held that judicial bias alone is insufficient to justify disqualification or recusal, adding that it must be personal or based on judicial reasoning.
The judge subsequently ruled that the application for his recusal lacked merit and promptly rejected it. This decision paves the way for the corruption trial to continue.
