A Federal High Court in Port Harcourt has thrown out a lawsuit filed by the Labour Party in Rivers State challenging the alleged defection of Martin Amaewhule, the suspended Speaker of the Rivers State House of Assembly, and 26 other lawmakers.
In his ruling on Tuesday, Justice Emmanuel Obile stated that the court lacked jurisdiction to hear the case, citing a recent Supreme Court decision that had already resolved the defection issue. He dismissed the suit, noting that the apex court’s judgment was binding.
Ken Njemanze, Senior Advocate of Nigeria and counsel to the defendants, had urged the court to dismiss the suit, arguing that the Supreme Court’s ruling upheld the lawmakers’ legitimacy. Conversely, Labour Party’s counsel, Clifford Chuku, contended that the defection was a secondary issue in the Supreme Court case and pressed for the suit to proceed.
