Kevin Costner is making another attempt to have a sexual harassment lawsuit dismissed, filed by stunt performer Devyn LaBella, who alleges she was forced to take part in an unscripted and unplanned rape scene on the set of the Western film series "Horizon."
A judge previously dismissed two of LaBella’s 10 claims, but Costner has now appealed, seeking to have the remaining eight claims thrown out. LaBella originally filed the lawsuit in May, asserting that the scene was imposed on her without consent. Costner has denied that any violent rape scene occurred on set and characterized the lawsuit as a “textbook shake down.” His legal team previously filed a motion to dismiss in August, and the latest appeal represents the next step in the ongoing legal battle.
