Halle Berry and Olivier Martinez's 13-year-old son, Maceo, has been permitted to testify in proceedings concerning Martinez's request for a domestic violence restraining order against the actress.
According to court documents obtained by TMZ, his testimony will be "limited to the request for the issuance of a restraining order".
The judge directed that Maceo testify in a closed courtroom, with only the parties, their lawyers and court personnel present. Martinez alleges that Berry attacked their son during an argument over a virtual reality video game, placing her hands around his neck and choking him. Berry denies hurting Maceo. Martinez is seeking sole custody and an order requiring Berry to stay away.
Berry opposed allowing their son to testify, alleging that Martinez had coached him. In her response to the restraining order application, she also questioned whether Maceo's account could be treated as reliable. She argued that he had a "personal interest in minimizing his own conduct and shifting responsibility to others".
Berry further alleged that Martinez had involved Maceo in adult disputes for years, creating a parenting dynamic in which she enforced rules while he allowed their son more freedom. She said this had led Maceo to view her as the "bad guy" and Martinez as the "good guy" for granting him "greater autonomy".
Berry expressed concern that his testimony could reflect "perceptions developed over time" rather than an accurate account of the disputed incident. The decision allowing Maceo to testify does not determine the underlying allegations.
